New “Amazon Tax” attack ad

I found this video this morning through Twitter. While I normally loath political attack ads like this, I decided that since I had taken a position (somewhere in the middle) it would be a good idea to let the “for” side have a say. This video was produced by StandWithMainStreet.com, and it is an attack ad in the style of all the slimy political attack ads you’ve seen over the years.

Ebooks aren’t taxable in New York State

Forbes turned up a rather interesting document the other day.

According to an advisory opinion (PDF) written by a tax attorney in the NY State tax office, ebooks aren’t taxable. That attorney thinks that ebooks don’t belong in any current tax category. They’re not exempt, per se. It’s just that the tax code was written before ebooks existed and its very carefully defined categories don’t cover all the technological innovations of the past few years.

Basically, ebooks happen to have fallen through a loophole in the tax laws. But I wouldn’t get my hopes up just yet; this is just an advisory opinion. It’s good only as far as you can throw the first tax assessor  who disagrees with it.

Texas going after Amazon – Again

Only this time the state of Texas has the law on its side.

Governor Rick Perry of Texas signed a new state budget into law on Tuesday. Among the many components of the new bill was a part that redefined the term nexus.

You see, Amazon have been avoiding the duty of collecting taxes in most states because they don’t operate in those states, and thus don’t have a nexus there. The new law in Texas redefines nexus so it includes such things as Amazon’s distribution centers. I know it might sound odd that a warehouse facility didn’t qualify as operating in the state, but before the law changed technically Amazon did not operate in Texas (here’s why).

The (Online) Taxman Cometh

If the Main Street Fairness Act passes Congress, your ebooks smorgasbord will come with a side of sales tax. The growing fight between web retailers and the various states who want to collect sales taxes has caught the attention of Congress.

Online purchases fall into a carefully created crack in the tax code. Buyers need to pay sales tax, but there’s no easy way to collect it from them, so sellers are required to do so. But if a seller doesn’t operate in a given state, it doesn’t have to collect the tax for that state.
